Terms of Service (AGB)

1. Scope
These Terms of Service ("Terms") govern your access to and use of the Kreatures web application and related services provided by Paola Sanchez ("Provider", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
2. Services Offered
Kreatures is an AI-powered productivity platform offering various tools such as Pilot Mode, Clarity Coach, and Priority Engine. We offer a free tier and may offer paid subscriptions. We may modify or further develop the Service where this is reasonable for users, for example to improve features, comply with legal requirements, or maintain security. If we intend to discontinue or materially restrict a feature that is part of a paid subscription, we will notify affected subscribers by email in good time, at least six weeks in advance where possible. In that case, subscribers may cancel their subscription with effect from the date the change takes effect and will receive a pro-rata refund of any fees prepaid for the period after that date. Features of the free tier may be adjusted or discontinued with reasonable prior notice.
3. Account Registration
To use our dashboard, you must register using your Google Account. You are responsible for safeguarding the credentials you use to access the Service and for any activities or actions under your account.
4. User Responsibilities
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Exploit, harm, or attempt to exploit or harm minors.
- Transmit any advertising or promotional material without our prior written consent.
- Engage in any automated data gathering (scraping, crawling) without permission.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Paola Sanchez and her licensors. The Service is protected by copyright, trademark, and other laws of both Germany and foreign countries.
6. Medical Disclaimer
Kreatures is designed as a productivity and executive function tool. It is NOT a medical device, nor does it provide medical advice, diagnosis, or treatment. It is not a substitute for professional mental health care or therapy.
7. Limitation of Liability
In no event shall the Provider be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The exclusive place of jurisdiction for all disputes arising from this contract is the registered office of the Provider, provided the user is a merchant or legal entity.
9. Subscriptions, Renewal and Cancellation
Paid subscriptions run for the billing period selected at purchase (for example weekly or monthly) and renew automatically for the same period unless cancelled. You may cancel a subscription at any time with effect from the end of the current billing period; the statutory right to extraordinary cancellation for good cause remains unaffected. You can cancel via the cancellation button on our Cancel Your Contracts page (Sec. 312k BGB), by email to care@kreatures.org, or through your account settings where available. We will confirm receipt and the effective date of every cancellation by email. For consumers, the statutory 14-day right of withdrawal applies in addition; see our Right of Withdrawal page.
